Conditions of use of the photo database

Südtirol Marketing (SMG) grants free on-line access to its own photo databank for the downloading of pictures. By clicking on the box “Yes, I agree”, the user accepts the following terms and conditions.

Copyright and rights of use
1. All pictures available for download are protected by copyright. Consequently the rights of use of the pictures remain with the photographers who are named in the accompany picture information. In using the photographic material the individual sources must be identified in accordance with Art. 3.
2. The use free of charge of the photo databank and the downloaded image files is permitted exclusively for the following purposes:
- journalistic purposes, i.e. for PR activities which can be connected with South Tyrol, and
- for tour operators in their quest to promote South Tyrol.
3. The use free of charge of the fotos is allowed for 2 years from the download.

Interdiction of use
1. Any use going beyond those set forth in Art. 1, especially for commercial purposes, is not permitted.
2. In the use of photographic material the interests of the photographer must always be respected appropriately. Above all the pictures must never be used in connection with pornographic, racist, extreme right-wing or other contexts which go against good taste.
3. The use of the photos in any context which could compromise the reputation and standing of South Tyrol is expressly forbidden.
4. It is forbidden to distribute the photographic material to third parties, especially with the purpose of sale or reproduction.The SMG reserves the right to investigate any suspected improper use of the photographic material.

Source information
In using the pictures the user is required to attach a credit detailing the source in as far as it is technically possible, either to the picture itself or in the media in which it appears (i.e. Source: Südtirol Marketing/name of the photographer).

Editing /modifying
The photographic material may not be changed, edited, modified or manipulated.

Exemption from third-party claims and liability
SMG is not liable for damages resulting from any breach of the Conditions of Use according to Art. 1 and 2. The user alone is liable for damages claimed by third parties. In this respect the user exempts the SMG from all claims made by third parties.
